The Little Handbook on Pre-Conception and Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994

Pre-Conception and Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994 is a detailed piece of legislation sought to prohibit and prevent the use of technology for sex determination of the foetus and/or assist in pre-birth sex selection. However, the implementation of this well-thought legislation has failed to achieve its objectives and sex-selective birth continues to haunt the future of Indian society.

The book analyzes the PC PNDT Act, the mechanism specified in it and the offences and penalties provided therein to implement the said objectives. It examines the evolution and growth of jurisprudence regarding the Act and its objectives and the stance that has been taken in several cases where judicial recourse was sought. Various courts have interpreted and applied the Act in such a manner so as to ensure that the guilty are not let off scot-free. The Supreme Court had also mandated the Government to ensure effective implementation of the provisions of the Act. This book is an attempt to analyze and understand the actors that render the execution of the Act, which is far away from reality. It also aims to provide recommendations and solutions in order make it effective and having a widespread reach.
